1Acceptance of Terms & Eligibility

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and TezApply (“we,” “us,” or “our”), governing your access to and use of the TezApply website, software applications, APIs, and associated career management tools (collectively, the “Platform” or “Service”).

By accessing, creating an account, or otherwise using the Platform, you represent and warrant that:

• You are at least 18 years of age and possess the legal capacity to enter into a binding contract;
• You have not been previously suspended, banned, or removed from the Platform;
• You will provide accurate, current, and complete registration information;
• Your use of the Service complies with all applicable local, national, and international laws and regulations.

If you do not agree to these Terms in their entirety, you are strictly prohibited from accessing or using the Service.

2Description of Services

TezApply is an automated career management platform designed to help job seekers discover employment opportunities, generate tailored job outreach emails, track job application statuses, parse and manage resume documents, and dispatch personalized correspondence through connected email accounts.

The Platform incorporates artificial intelligence (“AI”) and programmatic automation to assist users in structuring resumes, drafting cover emails, and scheduling communication. You acknowledge that AI-generated suggestions are assistive tools and you remain solely responsible for reviewing, verifying, and approving all content before dispatch.

3Account Registration, Identity Verification & Security

To access core features of the Service, you must register for an account. During registration, you must provide a valid full name, a verifiable email address, and a functional mobile phone number.

• One Account Per Person: Each natural person may maintain only one active account. Creating multiple accounts or exploiting aliases to bypass plan limits or trial quotas is strictly prohibited.
• Identity Verification: We reserve the right to verify your mobile phone number and email address through one-time passwords (OTP) or authentication challenges.
• Credential Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify TezApply immediately of any unauthorized account access.

4Connected Email Accounts & Third-Party Services

When you connect an external email account (such as Google Gmail or Microsoft Outlook) via OAuth 2.0, you grant TezApply permission to transmit outgoing application emails and follow-ups on your behalf upon your explicit instruction.

• User as Sole Sender: You are the sole sender and publisher of all emails dispatched through your connected account. TezApply acts strictly as an automated software conduit.
• No Inbox Scraping: TezApply accesses your email account strictly within the authorized OAuth scopes necessary for sending messages and tracking application message IDs. We do not read, store, or sell your unrelated incoming personal communications.
• Compliance with Provider Policies: You agree to comply with Google's Acceptable Use Policy, Gmail Program Policies, and Microsoft Services Agreements when using connected accounts.

5Acceptable Use & Anti-Spam Obligations

You agree to use the Service exclusively for lawful personal job hunting and career outreach. You expressly agree that you will NOT:

Violation of this Acceptable Use Policy constitutes grounds for immediate, permanent account termination and forfeiture of any prepaid fees.

6Data Retention, Post-Account Deletion & Anti-Abuse Preservation

This retention is conducted under our legitimate interest in securing our platform, protecting third-party recipients from spam, preventing fraud, and fulfilling statutory accounting, tax, and cyber-security compliance standards.

7Subscriptions, Billing, Razorpay & Refunds

Certain features and application tiers require a paid subscription.

• Payment Processing: Payments are processed through authorized payment gateway partners, including Razorpay. By initiating a purchase, you agree to Razorpay's applicable terms and authorize recurring charges where elected.
• Recurring Billing: Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date via your account dashboard.
• Taxes: All listed fees are exclusive of applicable taxes (including Goods and Services Tax / GST) unless explicitly stated otherwise.
• Refund Policy: Except where required by applicable law or specifically stated in an active promotional guarantee, subscription fees are non-refundable once the billing period has commenced and digital quota allocation has occurred.

8Intellectual Property & User Content

Your Content: You retain ownership of all resume documents, personal profile information, and cover letters you upload or create on TezApply. You grant TezApply a non-exclusive, worldwide, royalty-free license to store, process, parse, and transmit this content solely for the purpose of delivering the Service to you.

Platform IP: All copyrights, trademarks, software code, UI designs, algorithms, and documentation associated with TezApply are the exclusive proprietary property of TezApply and its licensors.

9Disclaimers & “As-Is” Provision

10Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall TezApply, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of business opportunities, or reputational harm arising out of or related to your use of or inability to use the Service.

In no event shall our total aggregate liability arising out of or relating to these Terms exceed the greater of ₹1,000 INR or the amount you paid to TezApply in the three (3) months preceding the claim.

11Indemnification

You agree to defend, indemnify, and hold harmless TezApply, its officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from: (a) your violation of these Terms; (b) your violation of any third-party rights, including anti-spam, privacy, or intellectual property rights; or (c) the content of any emails or applications dispatched via your account.

12Suspension & Termination

We reserve the right to immediately suspend, restrict, or terminate your access to the Service at our sole discretion, without prior notice, if we believe you have breached these Terms, engaged in spamming, exploited platform resources, or engaged in fraudulent conduct.

Upon termination, your right to use the Service ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, anti-abuse data retention, warranty disclaimers, indemnity, and limitations of liability.

13Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.
